Information on levies

The European Directive on collective management, transposed into French law in late 2016, stipulates that collective management organisations must inform their members, at least once a year, of any levies that will be made from the authors' rights paid to them.

In the interests of transparency, Sacem has decided to provide this information at the time of each distribution. As of the July 2018 distribution, members will now find the amounts deducted for management fees and cultural and social support programmes, and how they are deducted from the total gross amount of their authors' rights payment, at the bottom of their distribution sheets.

Management fees

These are the levies that Sacem makes to cover the costs of collecting and distributing authors' rights (article 8 B 8° of the Statutes). The representatives of authors, composers and publishers on the Board of Directors keep a careful eye on the methods and resources used to ensure the accuracy of these transactions. Management fees must obviously take into account the specific complexity and costs inherent to each sector in which the works are used.

Cultural and social support programmes

In accordance with article 4 items 2 and 3 and article 33 of the Sacem Statutes, levies are made for cultural and social activities from the Society’s net revenue from the exercise of rights directly managed by the Society. This represents 10% from public performance rights and 3% from mechanical reproduction rights (5% for private copying rights), except where specific provisions are determined by the Board of Directors for certain types of use.

Part of the amounts collected is used to fund Sacem's cultural support programmes, but the bulk of the levies is allocated to pension and social security funds. The main objective of this initiative, the Régime d’Allocations d’Entraide de la Sacem [Sacem Assistance Allowance Scheme], is to pay benefits, under certain conditions, to members over 60 years old until their death, and then a percentage of the benefit to the surviving spouse. The levies enable all members to accumulate points in Sacem's Assistance Allowance Scheme during their careers. Also within the context of this social initiative, there is a social welfare fund for contributions to Mutual Assistance, Death Benefit and Emergency Relief.

In the cultural domain, Sacem has a strong tradition of supporting musical creativity and live performance and enabling young creators to gain professional experience. It provides aid to authors, composers (assistance with self-production, residencies, career support, scholarships, etc.), and publishers, and also to users of the music (financial support for cinemas, festivals, producers, etc.) who book these artists and promote them in France and abroad. Sacem also provides artistic education and coordinated cultural projects in order to raise the awareness of musical diversity and make it available to everyone. Most of this cultural support activity is financed by levies of 25% from amounts collected for private copying fees, in accordance with article L 324-17 of the French Intellectual Property Code.
